The City of Texarkana, Arkansas, has ordinances in regard to going door to door for sales.
The police have been getting calls about a group going door to door and crossing gates and fences in order to do so. This act is considered trespassing.
According to police, you have no obligation to allow anyone into your home or property and should call the police if they refuse to leave.
If you encounter a problem with a salesman contact city hall during the daytime hours to file a complaint that will be investigated by the city. If a salesman is coming to your property after the sun goes down, city hall is likely going to be closed, you can contact the police department.
Public Works Director Tyler Richards indicated there is only one current permit issued to Edward Jones Company. A copy of the ordinance is listed below.
Sec. 13-6. - Solicitation from house to house for magazine subscriptions, etc.
(a)
It shall be unlawful for any person to go from house to house or place to place in the city selling goods or wares, or soliciting or taking orders for subscriptions to magazines without having first registered with the city treasurer and giving the following information:
(1)
Name, home address and local address, if any, of registrant.
(2)
Name and address of the person, firm or corporation, if any, that said salesman represents, or for whom or through whom orders are to be solicited or cleared.
(3)
Whether the registrant, upon any sale or order, shall demand, receive, or accept payment or deposit of money in advance of final delivery.
(4)
Period of time during which registrant wishes to solicit or sell in the city.
(b)
In addition to furnishing the foregoing information, the magazine subscription salesman shall pay in advance to the city treasurer the occupation tax required by sections 13-33.
(c)
It shall be unlawful for any person to sell goods or wares, or to solicit or take orders for magazines or subscriptions to magazines under this section before 8:00 a.m. and after sundown on any day.
